Terms & Conditions of Holiday Letting

ACCEPTANCE AND RESPONSIBILITY

Payments of the deposit constitutes acceptance of these terms and conditions failure to comply with any of the guests obligations and the terms and condition of the property may result in immediate termination or eviction. Refunds will not be paid on terminated occupancies.

The premises are let to you for holiday purposes only, for the period stated on your receipt.

 

CHECK IN/OUT

Check in time is not before 2pm on the arrival date and check out time is not later than 10am on the departure date if you remain in the property after 10am you will be charged an extra day.

Late departure is subject to prior arrangement and availability - extra charges will apply.

 

KEYS

Check-in/check-out and key collection/return procedure will be as follows Collect and Return Keys at Harcourts Byron Bay Cnr Fletcher and Lawson Streets Byron Bay NSW 2481 if unattended please use the security deposit box located right of the front doors enter code and turn the handle the code will be provided before check in through SMS or email The envelope will be clearly marked with the booking name unless special arrangements have been made prior to arrival.

If any keys are lost or misplaced all locks for that property will need to be changed by a locksmith at a cost to the guest. A call out fee will also be applied.

All keys must be returned to our office on departure and not left at the premises.

 

 

SECURITY BOND/TARIFFS/DEPOSITS

 

To secure your reservation a 50% deposit of the total Tariff is required plus the non refundable $55 Booking fee which is required within 24 hours of making the booking.  If this payment is not made within 24 hours or the correct amount is not paid the booking will be automatically cancelled. 

 

A bond payment of $500 is required at the same time as the outstanding balance of your Booking THIRTY (30) DAYS PRIOR TO YOUR ARRIVAL. The Bond will be credited back to your designated bank account once the property has been inspected and deemed left in a similar state to your arrival. We agree to ensure this occurs within 14 working days of your departure. This is not available Either:

Any damage, loss or expense incurred by Management as a result of your breach of these Terms & Conditions will be charged against the bond. Examples of this include but are not limited to any breakage, damage or excess cleaning requirements, extra guests beyond those declared. Or:

Any damage loss or expense incurred by Management as a result of your breach of these Terms & Conditions will be charged against the credit card. Examples include but are not limited to any breakage, damage or excess cleaning requirements, extra Guests or Visitors beyond those declared.

 

Final payment and $500 security deposit (schoolies $1500) is due 30 days prior to arrival. If the booking is made within 30 days of arrival, full payment will be required at the time of booking. If Credit card authority has been given we will deduct the balance on the due date unless otherwise advised by you.

 

 

UNAVAILABILITY

If the Property becomes unavailable for your occupancy due to unforeseen circumstances (eg. fire, storm, damage, etc) then Management will inform you immediately and endeavour to obtain suitable alternative accommodation for your occupancy; failing which any moneys paid will be refunded in full.

All bookings are accepted By Harcourts Byron Bay in good faith as agents for the property owners, We can not be held responsible for the actions taken by the owner of the premises such as the property is sold, the tariff is increased without notice, the property is altered in any way, the property is withdrawn from letting. Should this occur every reasonable endeavour will be made to find alternative accommodation.

 

PARTIES & FUNCTIONS, NOISE

Either Parties and Functions are strictly prohibited. No noise between 10pm and 8am with no excessive noise at any other time.  All outside areas to be clear between 10pm and 8am.  Noise means not one neighbour is disturbed by any means.

In Byron Bay there is a noisy neighbour service/Hotline that operates 24/7 to ensure holiday letting does not have a negative impact on our community this service responds to every complaint if the hotline is called this may result in a call out charge if so the fee will be taken from the guests security deposit and is non-negotiable. If they are called out for a second time during a guests stay all guests will be evicted from the premises without a refund of any security deposit or Rent paid.

Harcourts Byron Bay takes no responsibility for any issues relating to noise or construction noise on neighbouring properties.

 

LINEN AND TOWELS - SELF CONTAINED HOLIDAY ACCOMMODATION

We supply linen, ,(Pillowslips, Tea towels, Bed sheets, Bath towels, (1 per person) which must be left where supplied in the bedrooms or bathroom on departure. If you require further linen it may be hired by calling Byron Bay Holiday Hire on 02 6685 6247. Beach towels are not included.

Please note this property is fully self contained however it is not a serviced property.

 

PETS

Animals and pets are not allowed on or inside the premises, under any circumstance.

 

CANCELLATIONS/DATE CHANGES/ALTERATIONS

All Booking cancellations will incur a $100 Administration Fee.

If cancelled 3 months prior to your stay a refund will be given minus booking fees and administration fees.

If cancelled less than 3 months prior to your stay any refund is subject to the re booking of that property for the entire allocated period for the same dates and Tariff.

If you decide you want to shorten your stay unfortunately refunds will not be granted OR if for whatever reason you are not satisfied we do not refund rental costs in full or part thereof.

Date changes will be to the discretion of Harcourts holiday management team and may incur change of booking fees and rent charges for different seasons.

All changes must be in writing by the person who made the reservation/booking.

The Booking fee and credit card fees are not refunded under any conditions.

 

PARKING

Each property that is listed with Harcourts outlines the number of off-street Carparks available to the guest, We are not responsible or liable for any fines or penalties incurred by guests or visitors from parking where metered restrictions apply.

 

 

GARBAGE

all rubbish put in the appropriate council rubbish bins provided it is the duty of the tenant to put the garbage (red bin) or recycle (yellow bin) on the kerb outside the property on the correct collection day as indicated in that property. Removal of any excess rubbish left by tenant will incur charges for removal or tip fees.

 

YOUR OTHER RESPONSIBILITIES

You must comply with all applicable House Rules and all instructions from Management and the caretakers of the Property concerning occupancy, property, health, safety and quiet enjoyment of the Property and our neighbours.

You are responsible for damage, breakages, theft and loss of the Property and any part of it during your stay. You must notify us of this immediately. Management may recover from you repair or replacement cost (at Management's discretion)

Only the guests nominated and agreed in the Booking may stay in the Property over night. If any other guests stay extra charges may apply or the agreement may be terminated without refund.

Before departure, all food must be removed from fridges, and crockery and cutlery washed and packed away. The Property must be left in a clean and tidy condition.

Extra cleaning charges may be incurred for the cleaning of dirty dishes, washing machine, dishwasher, emptying the fridge, removal of excessive rubbish etc. Should the cleaning fee be more than the usual cost for cleaning the property, you will be charged the additional costs over and above the normal cleaning fee which will be deducted from the security bond or charged to your credit card

All furniture and furnishings must be left in the position they were in when you arrived

The property should be vacated on time and secured. All windows and doors are to be locked. All keys must be returned to Harcourts Byron Bay unless directed otherwise.

You are responsible for the safekeeping and replacement of accommodation keys. Duplicate keys will be provided at an additional charge.

Smoking is not permitted in all accommodation.

           

BY LAWS AND COMMON PROPERTY

 

 Where the Property is part of a strata or community title scheme:

a) Guests and Visitors must comply with owners' corporation by-laws and the lawful directions of managers and caretakers of the scheme; and

 b) Guests are responsible for damage to common property by Guests or their Visitors and this is a ground for drawing upon or charging the security deposit or bond

 

PROBLEMS OR COMPLAINTS

In the case of any problem or complaint, you must inform Management at Harcourts Byron Bay on (02) 6685 6552 at the earliest opportunity so Management has the chance to rectify the situation as quickly and efficiently as possible. You must allow repair/service access to the property during reasonable hours. Failure to follow this procedure this may hinder the ability of Management to rectify the problem or complaint and reduce or extinguish any claim you may have.

If on arrival your property has not been cleaned please contact the office immediately so the cleaners can attend as soon as possible. We cannot be help responsible for delays by cleaning staff.

The description of the property given is given in good faith as us as agents, Harcourts Byron Bay will not be held responsible for changes to or any items removed from the property after the time of your booking.

Harcourts Byron Bay reserves the right to alter, cancel or change any of these Terms and Conditions as a result to changes in the holiday market, changes in Legislation, or the requirements of property owners, and Body corporate at any time without notice.

We recommend all guests purchase travel insurance since Harcourts Byron Bay are not responsible for any injuries, illness or accidents that may occur whilst staying at our property.

If there is anything you do not understand or questions you have speak to the agency staff – ID will need to be supplied on arrival along with any guest registration forms we require prior to your booking or at the time of arrival.
